OVERVIEW

Welcome to The Last Tee. "We", "us" and "our" mean The Last Tee, a sole trader (Sebastián Fernández Alberdi) based in Madrid, Spain. We run this store on Shopify and work with print-on-demand and fulfilment partners to produce and ship every tee — nothing is made until you order it.

By visiting the store, browsing it, or placing an order, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy and Refund Policy, all linked from the footer. If you don't agree, please don't use the store.

SECTION 1 - ACCESS

You must be old enough to enter a binding contract where you live, or have a parent/guardian's consent. When you check out, you're confirming the information you give us — email, shipping and billing address, payment details — is accurate and yours to give.

SECTION 2 - OUR PRODUCTS

Every design is printed to order and can be pulled from sale for good at any time — that's the whole idea behind The Last Tee. What's live today may not be tomorrow, and a retired design generally won't come back. We try to show colours and prints as accurately as we can, but screens vary, and fabric takes ink differently depending on the tee's colour (see the Refund Policy for what that does and doesn't cover).

SECTION 3 - ORDERS

Placing an order is an offer to buy; it's accepted once we confirm it by email and your payment goes through. Because production starts almost immediately, we usually can't make changes or accept cancellation requests once an order is placed, except where required by applicable law — double- check size, colour and address before you pay. Returns and exchanges follow our Refund Policy.

SECTION 4 - PRICES AND TAXES

Prices are shown with applicable taxes included where required by law. Any applicable shipping, customs or import charges are shown at checkout or described in our Shipping Policy. Prices, launch discounts and promotions can change without notice; what applies is what you see at checkout.

SECTION 5 - SHIPPING

Covered in full in our Shipping Policy. Delivery estimates are estimates only. Delays may occur due to carriers, customs, holidays or other circumstances outside our reasonable control. Nothing in these Terms limits your legal rights if an order is not delivered within the applicable period.

SECTION 6 - RETURNS, REFUNDS AND YOUR RIGHT TO WITHDRAW

Covered in full in our Refund Policy, including the EU 14-day withdrawal right and what counts as a print defect versus normal made-to-order variation.

Nothing in these Terms or our Refund Policy affects your statutory rights in relation to defective or non-conforming products. Where a product is defective or does not conform to the contract, you may have rights to repair, replacement, price reduction, refund or other remedies under applicable law — this is separate from, and in addition to, the right of withdrawal. Nothing here limits any legal guarantee of conformity or other consumer right you have under the law applicable to your purchase.

SECTION 7 - INTELLECTUAL PROPERTY

The designs, the store's text, layout and graphics, and The Last Tee name and logo belong to us or to whoever licensed them to us. You're welcome to buy and wear a tee, share a photo of it, tag us — that's the good kind of reuse. You may not reproduce, resell, or otherwise commercially exploit our designs or site content without our written permission.

SECTION 8 - THIRD-PARTY TOOLS AND LINKS

The store runs on Shopify and works with print-on-demand and fulfilment partners for production and shipping, plus other tools for payments, analytics and marketing. Some pages may link to third-party sites we don't control. We're not responsible for the content, policies or practices of those third parties — check their own terms before you rely on them.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

The Last Tee is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with The Last Tee. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Last Tee, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with The Last Tee.

SECTION 10 - PRIVACY

How we and Shopify handle your personal data is explained in our Privacy Policy. By using the store you confirm you've had the chance to read it.

SECTION 11 - FEEDBACK AND USER CONTENT

If you send, post or submit a review, comment, photo, suggestion or other content to us, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, publish and adapt that content for the operation, improvement and promotion of The Last Tee. You remain the owner of your content. You confirm you have the rights necessary to grant us this permission and that your content doesn't infringe anyone else's rights. Don't send us anything false, illegal, abusive, or that infringes someone else's rights; we can remove or ignore content that does.

SECTION 12 - ERRORS

Prices, descriptions or stock can occasionally be wrong. We can correct errors, update information, or cancel an affected order — including one already paid, in which case we refund it in full.

SECTION 13 - PROHIBITED USES

Don't use the store for anything unlawful, to infringe someone's rights, to spread malware or spam, to impersonate anyone, or to scrape, resell or otherwise exploit our content without permission. We can suspend or block access if we believe these terms have been broken.

SECTION 14 - AUTOMATED AGENTS

If you use a bot or AI agent to interact with the store on your behalf, it must identify itself as such (via its user-agent string), behave truthfully about being automated, and not attempt to bypass CAPTCHAs or other measures meant to tell humans from machines. We can restrict how agents access the store.

SECTION 15 - TERMINATION

We may suspend or restrict access to the store where reasonably necessary, including where we believe these Terms have been breached, without notice. Sections that by their nature should survive termination — intellectual property, feedback, disclaimers, liability, indemnification — continue to apply.

SECTION 16 - DISCLAIMER

The store and its content are provided "as is". We don't guarantee it will be uninterrupted, error-free, or exactly as expected, beyond what the law requires us to guarantee.

SECTION 17 - LIMITATION OF LIABILITY

To the extent the law allows, The Last Tee isn't liable for indirect, incidental or consequential damages arising from your use of the store or a purchase made through it. Nothing here limits rights you have as a consumer that can't be waived under applicable law, including your legal guarantee of conformity.

SECTION 18 - INDEMNIFICATION

You are responsible for losses we reasonably incur as a result of your unlawful use of the store, your intentional misuse of our Services, or your infringement of our intellectual property or third-party rights.

SECTION 19 - SEVERABILITY & ENTIRE AGREEMENT

If any part of these terms turns out to be unenforceable, the rest still stands. These terms, together with our other posted policies, are the whole agreement between you and us about using the store.

SECTION 20 - ASSIGNMENT

You can't transfer your rights or obligations under these terms without our written consent. We may transfer ours as part of running or restructuring the business.

SECTION 21 - GOVERNING LAW & JURISDICTION

These terms are governed by Spanish law. Any dispute will go to the courts of Madrid, Spain, without prejudice to any mandatory consumer-protection rights or venue you're entitled to under the law of your own country of residence.

SECTION 22 - CHANGES

We can update these terms at any time by posting the new version here. Continuing to use the store after a change means you accept it.
